Faleke Writes APC Again Claiming Is The Governor-elect #KogiDecides

John Faleke and Prince Abubakar Audu
The Kogi State All Progressives Congress’ deputy governorship candidate, John Faleke, who shared a ticket with the late Abubakar Audu, has again written to the national chairman of the party, John Oyegun, insisting he is the governor-elect and should so be declared.

The Independent National Electoral Commission had declared Saturday’s election inconclusive. Before then, collated results from majority of the local government showed Mr. Audu was in the lead.

The APC candidate died onSunday, prompting the party to commence the process of
choosing a new flag bearer — as directed by INEC.

The APC in Kogi nominated the son of the late Audu, Mohammed Audu, to become the candidate, while the Peoples Democratic Party, PDP, said its candidate, incumbent Idris Wada, should be declared governor.

In his first letter to INEC onWednesday, Mr. Faleke said he was the proper beneficiary of the
cast vote, and urged the commission to declare him governor-elect.

In a second letter to Mr. Oyegun, obtained by PREMIUM TIMES, Mr. Faleke, through his lawyer, Wole Olanipekun, again highlighted the
danger of acceding to INEC’s directive of selecting a fresh candidate.

Mr. Faleke said INEC and allparties to the election had already reached a point of no return. He said holding a supplementary
primary to produce a candidate for a supplementary election in 91 polling units can only produce a supplementary governor for Kogi state.

Mr. Faleke said the total numberof outstanding votes in the remaining 91 polling units are not
more than 25, 000 and that even if all the registered voters vote for the new candidate, it would mean the new governor would be a governor of 91 polling units only.

He cited section 197(2) (b) of the 1999 Constitution which states that “(2) A candidate for an election to the office of Governor of a State shall be deemed to have been duty elected where there being two or more candidates. (b) He has not less than one- quarter of all the votes cast of at least two-thirds of all the local government areas of the state”.

Mr. Faleke also recalled that in 1999, when the
governor-elect of Adamawa state, Atiku Abubakar, was made Vice President, INEC ordered a rerun election to produce a fresh
governor.

But he said, the PDP challenged the decision saying Mr. Atiku’s deputy, Boni Haruna,
should automatically be made governor.

He said the legal battle surrounding the matter went up to the Supreme Court which ruled in favour of the PDP allowing Mr. Haruna to serve as governor and even winning re-election.

Mr. Faleke equally reminded Mr. Oyegun of how some leading members of the APC in coalition with some “decent forces” in the country, bandying the “doctrine of necessity”, championed the course of then Vice President Goodluck Jonathan to be appointed acting president when the president at the time,

Umaru Yar’adua, became terminally ill. He said Mr. Jonathan thereafter became substantive president for six years.

“If we could rely on the ‘doctrine of necessity’ and maximally utilize same to make Vice President Goodluck Jonathan the sitting president, it then goes without saying that both INEC and APC must submit themselves to the doctrine of constitutional imperative and / or necessity to allow our client to be governor-elect of Kogi state,” the letter reads.

Mr. Faleke and his lawyers said they were “ready and willing” to articulate and defend
their position before any organ of the party.
He vowed not to “trade off or compromise his
mandate as the governor elect of Kogi state”.

My take:
Faleke should thread wife caution, party decision is final on anything that involves political party.

Buhari has had six months of deceitful change – Ayo Fayose

The Ekiti State Governor, Ayodele Fayose, has
described the six months of President Muhammadu Buhari’s administration as that of “deceitful change”.

Fayose lamented that the President was destroying the image of Nigeria and its people for cheap international recognition.

The governor, who also described the claim by the Minister of Finance, Kemi Adeosun, that the ministry does not have details of any fund recovered from officials of the immediate past government of Dr. Goodluck Jonathan as a vindication of his position that Buhari was not saying the truth, tasked Nigerians to ask the President where the so-called looted fund was paid and who made the payments.

He said: “If the Ministry of Finance is not aware of any recovered fund, it is either those who purportedly made the refund did so by loading cash into Ghana-Must-Go bags and dropping the bags in the President’s bedroom or the fund was lodged into the Central Bank without records.”

Speaking through his Special Assistant on Public
Communications and New Media, Lere Olayinka,
Governor Fayose said: “The only areas President Buhari has recorded tremendous achievements are areas of political persecution, disobedience of court order and desperate bid to turn the country to a one-party state as evident in the Kogi State election, which the Independent National Electoral Commission (INEC), headed by staged managed and muddled up.

“In the last six months, a section of the judiciary has been so openly manipulated by the Buhari’s
administration such that different judgments were given in similar cases, with the Peoples Democratic Party (PDP) getting negative judgments while the All Progressives Congress (APC) secured positive judgements in cases with similar facts and evidences.”

While sympathising with Nigerians, who were deceived to vote for the All Progressives Congress and are now bearing the brunt of the six months of Buhari’s administration’s cluelessness, Fayose said: “It is painful that Nigerians are being made to suffer great
hardships from fuel scarcity, thousands of people are still being killed in the North by Boko Haram, Chibok Girls are still not found, power supply has dropped, and above all; the unity of the country is being threatened as admitted by the Minister of Information, Lai Mohammed, yet all our President does is junketing around the globe.

“Honestly, this change promised by President Buhari and his party, APC, is nothing other than ‘one chance change’ and this has been attested to even by highly respected international news media.

“For instance, Bloomberg, in a report two days ago said hopes have fizzled in Buhari’s ability to turn around Nigeria and that money that flowed into stocks and bonds in Nigeria, which McKinsey & Co. says could become one of the world’s 20 biggest economies by 2030, is now fleeing as growth prospects dominion along with oil prices.

“Under President Buhari, the United States - based investment banking and financial services multinational J P Morgan ejected Nigeria from its Government Band Index for Emerging Markets (GBI-EM) with effect from the end of October this year.

“Under Buhari, the future of workers are being
threatened by the APC government plot to reduce minimum wage and retrench workers.
“Under Buhari, oil subsidy is to be removed next year January, thereby causing further hardship for the people.

“Under President Buhari, multi-national companies are laying-off thousands of workers while contractors working for the Federal Government have left their sites.

Yet, what the President does is to junket from
one country to another to cast aspersion on Nigeria and its people and one wonders how foreign investors will come to a country that its President says is peopled by rogues.”

Igala People Of Kogi State Protesting Over The Replacement Of Audu With Bello (Photo News) #KogiDecides

The leadership of the All Progressives Congress (APC) has announced the replacement of late Prince Abubarkar Audu in the last Saturday gubernatorial election in Kogi State.

Yahaya Bello was announced, the agreement was reached because he was the second in the primary election that produced late Prince Abubakar Audu.

This announcement triggered protest by irate youths. Kogi is known to be divided along ethnic lines before now, but the overall development of Kogi should be paramont to them, than wanton destruction of government infrastructures.

Igala people are now protesting due to the fact that someone from same Igala was not presented but Ebira extract.

6 Things To Look Out For Before You Buy Your Next Phone

Mobile phones are now integral parts of us, so one can not afford to continue living in the world of the past by not being a millenium compliant.

Phones' functions are now far more than just to make or receive calls and send short message service (SMS) only but can serve as our mobile offices.

Being in office while you were away cannot but be linked to the contributions of mobile phones and laptop computers.

The advantages of smart phones are too numerous to itemised.

This can only be achieved when you have smart phones with up-to-date applications that suit your line of work or business.

They are available for both have and have nots. The following underlisted factors should be considered before buying your next mobile phone or device.

1. Operating System (OS) version: Software developers develop different applications on daily basis, so buying phones with outdated OS may not help you.

For instance, social applications like Whatsapp and Blackberry Messenger (BBM) can not be installed on smart phones till date because their OS can not run it.

Illustration, if you want to buy Android phone and the version is less than 4.0, please don't buy it and on BB, if it is less than 6.0, don't as well.

2. RAM: RAM means Random Access Memory, this determines the speed of your device. I recommend minimum of 1Gb RAM most especially for people that love gaming a lot, if the RAM is small, you phone may be freezing (popularly known as hanging by some people).

3. ROM: ROM means Read Only Memory. It is regarded as to inbuilt memory storage of the phone. Your should be able to keep some data, information and files even without the external storage, otherwise known as memory cards.

Though I will not encourage you not to have external storage because there is a limit to what ROM can store, so that your device can function well.

If you are the type that love to have a lot of musicals cum videos on your phone, please get yourself an external storage, so that the phone can last.

4. Battery capacity: This refers to the standby time or usage time of your battery. It is calculated in "mHa". Check the battery, you will see it boldly written there, like 2600mHa.

The higher the number, the longer your battery will last. I remember my Blackberry bold 4, the battery capacity is 1,500mHa.... Power bank became second phone then because the battery drains easily.

But my present phone has a whooping value of 4000mHa, which serves me for two days....  Hope you know understand my point? Good you do!

5. Screen size:   This is very very individualistic, some have passion for big screens while the reverse is the case for others.

The size of your phone will determine the class that it will fall into, whether mobile phones, tablets or what have you.

6. Money: Ego, Kudi, Owo.....  Still referring to money but in our three major languages. The money that you can afford on the phone is equally a factor.

Some are phone freaks, they don't mind spending over N300,000 for just a phone....  Naxo!

But some as "Elegbe Gegede", they cannot break a bank because they want to change phone.

So the choice of the phone that you will buy is yours to make but don't over stress your finance because you want to impress.

I can go on and on....  But permit me to hang my pen here tonight, bed calling... LOL

keep visiting.....  More goodies are in stock, remember we will soon be in the Santa Clus' month.... Chuckles.

Shocking: Man Shot Dead A Dead A Waiter For Telling Him Not To Smoke In A Restaurant

Police say a man shot dead a Waffle House waitress after she told him not to smoke in the restaurant.

Johnny Max Mount allegedly pulled out a handgun and shot the 52-year-old woman in the head after she told him smoking was banned in the eatery in Biloxi, Mississippi.

Biloxi Police Sergeant Donnie Dobbs said officers arrived at the restaurant at 1am on Friday, and the employee died on the way to hospital.

Mount, 45, from Biloxi, was standing outside the
restaurant when police arrived and surrendered without incident, he said.

He was charged with first-degree murder and is being held on a $2m bond at the Harrison County Adult Detention Center.

Kelly Thrasher-Bruner, a spokeswoman for Waffle House, paid tribute to the unnamed employee.

"This senseless tragedy is a shock for the Waffle House family," she said.

"Our associate was a friend to many as well as a valued member of the Waffle House team for eight years as a salesperson.

"She will be greatly missed. Our prayers are with her family, friends, co-workers and customers."

I think there is more to this....... Because of only cigarette? Haba!

Mustapha Audu Releases Official Statement On The Rape Allegation Against Him By Sugabelly

Mustapha Audu
Since the allegations of rape against him by Sugabelly surfaced, Mustapha Audu had kept quiet amidst the whole  storm due to the mourning period he and his family are going through as a result of the unfortunate death of their patriarch Prince Abubakar Audu.
But all these have changed as Mustapha Audu has released a statement as regards the allegations.

The statement read thus:

I am shocked and disturbed about
these allegations I categorically deny the allegations of rape whilst admitting to a consentual relationship.

I wish to exonerate my brothers and friends of any wrong doing. I wish to thank my friends and family for their support as we grieve the loss
of our father barely a week ago.

It is unfortunate that we have to respond to these sort of wild and malicious lies at this time,This is a case of a very troubled young lady who had been stalking me and had at many times in the past tried to contact and blackmail
me.

she had initially started this a while back, but we chose not to respond out of respect for ourselves
and our loved ones.

We tried to ignore this as we neither wished to get involved in her fictious stories nor join issues with her.

However events of the past few days has compelled me to defend my honour even in my mourning period as the emails will later show.

These are some of the excerpts from the emails:

"Mustapha.. basically, I just miss you a lot. I don't know why.. I mean I do know why but I can't explain why I stop breathing every time I hear your name, even if it's not about you"

"I don't know why I decided to call you. It's been four months since I last heard you speak. I guess I knew to hear you would make me happy, so I did Say hi to Bashir for me, and to Abdul.
Call me Mona"

"you opened the door nearest to me on the ground floor.. Balked when I saw the bed.. I've never been good with beds... they scare me... visions of violent rape flood my brain and I get goosebumps... it's like having no air.. there are reasons for that... perhaps you'll find out later"

She later said to me that she was raped by her mother then boyfriend at a very tender age, you can now imagine my dismay at reading all her accusations.

I would like to ask, what kind of society do we live in when you are grieving the loss of your father and at the same time some opportunistic blogger is trying to unnecessarily capitalize on
this sensitive period in my life to taint me, my family and friends.

Sadly the teeming public without any evidence
whatsoever or benefit of doubt join the bandwagon of criticism.

I believe the court of public opinion as well as the legal courts will see these stories as false and malicious and declare me innocent.

I hate to think that this is an opportunist move and I would like to put this ugly incident behind me as we continue to mourn.

I have spoken to my lawyer on the best way to handle this matter, thank you.
Mustapha Audu.

EXCLUSIVE: Buhari’s Corruption Fight; Political Witch Hunt Says Tosin Arile

Tosin Arile
PoliFocus had an extensive interview with an unrepented social media activist and commentator, Tosin Arile on the state of the nation.

Arile who also spoke extensively on the President Muhammadu Buhari led administration and the present development that is trailing the death of Prince Abubakar Audu in the last Saturday gubernatorial election in Kogi State.

I bring to you the full interview:

Excerpt

Can we meet you?

I'm simply Olutosin Arile, a teacher in a tertiary institution and a political commentator.

You are known to be a passionate social critic.... Can you tell us why you do that?

I like the word passionate, yes it's true I'm passionate about development of my people which I strongly believe criticism in form of activism is but the right tool to deploy making our government more responsible taking care of our plight, it's a fact that every government is lazy especially those in Africa where aura of being in power is the only thing motivating many  aspiring to political offices, so the critics many called them are morally indebted rescue
democracy in form of restraining the excess of elected officers, you would agree being passionate doing this is but a right thing .

So what is your assessment of the last general elections?

The election exposed the ethnic induced  Nigerian atleast judging the result which no doubt rigged in places where each party actually has an advantage or what some nick stronghold, Buhari won the north, Jonathan won in the south south and east, only the west voted massively a northerner and you would agree the position of the All Progressive Congress vice presidential slot conceded to the region assisted luring many the Yoruba people, so as far as I'm concerned the last election is the poorest conducted in the history of the country, even in 2011, Jonathan got more votes in the north, why now if not because the political hatred has succeeded eating the moral fabric of the nation,
there's mistrust in the polity.

Don't you share the opinion that Goodluck Jonathan erred as to policy formulation and implemention in some areas which made people to clamoured for change?? For instance, issue of
corruption

As someone who believe in justice, equity and fairness, I don't agree Jonathan failed, I've said it countless times that emergence of Jonathan is a political failure on the part of those who consider no shoe and goodluck sentiment in 2011, a man can't give what he doesn't  have, it's justified that Jonathan failed in office because he only proved those who never voted for him in 2011 right that the outgoned president is intellectually incompetent to lead a nation like
Nigeria, we must also thank Jonathan because his governic ineptitude popularly called cluelessness gave the change people a voice, for instance if Jonathan had performed, we would never need a Buhari, yes it was apparent Jonathan has lost his headship because at a time he was quoted that if he fights corruption, that  corruption has potency fighting his second term ambition, which is more important to the people, his ambition or removing the cancer that has eating the political fabric of the nation, our only problem is corruption, so if many banked a believe that it's because Jonathan can't fight corruption they supported Buhari, the question we should ask now is if Buhari is actually fighting corruption.

In your view, what can you same to the introduction of "Card Readers" by INEC?

Card reader achieved one thing, it gave the election a form of what I nicked  technological credibility, in Nigeria we trust technology that the card readers merely been used as a form of accreditation gave the election in the unconsciousness of an average Nigerian a feelings that election are credible , it's untrue, for instance one don't need be a seer to know election were massively  rigged in Kano and Rivers for instance. Yes card readers doused the
emotions of our people because without it and perhaps Jonathan had been declared a winner, strongly doubt if there would not be post election violence that is capable of threatening the sovereign integrity of the nation.

What can you say about the state of the nation now, I mean Muhammadu Buhari led federal government?

So far so good Buhari hasn't delivered anything other than political rhetoric, in fact the noise about fighting corruption has been loud and yet nothing worthwhile has been achieved, I wish he succeeded taming the cancer corruption
but every day event proved otherwise, he seems to have soft spot for members of his political party who are corrupt atleast we saw how some ex governors with corruption allegations yet rewarded with ministerial appointment, in
my view the president hasn't done anything substantial to know if he has delivered, the appointment so far is the only thing that could be credited to this incumbent administration and I make bold to say that it does not represent the collective yearning of a new Nigeria because
it's a fact that it was ethnically skewed favouring a section of the country.

So you mean President Buhari has no political will to fight corruption head long? Because majority of us voted for him based on probity and his antecedent.

Well I once too subscribe to the beliefs that Buhari has a will power to fight corruption but everything since assumption of office suggest otherwise, the President seems to believe fighting corruption is actually fighting political opponents which fault the true essence of fighting the menace, so if one steals and decamp to the ruling party, technically his political sins are forgiving, is that a responsible way to deal with a vice that has threatened our collective welfarism in these past years ? If the president
is serious about fighting corruption that would have significant effect on the psyche of our people then the fight charity must begin with the ruling party members, in fact Obasanjo should first be prosecuted, anything short is mockery of the president allege reputation anything some
may erroneously believed is his antecedent.

So what can you say on the present conundrum cum hullabaloo that is trailing death of Audu Abubakar and decision of INEC as regards last Kogi gubernatorial election by declaring it inconclusive?

Maybe I should say that the INEC declaration of the poll inconclusive is political, there is no antecedent worth using to emphatically predict the court but one thing I know, INEC has no legal jurisdiction to make further pronouncement on
the said election, the court would say the next thing, many had said a lot, though many opinion is geared towards supporting their partisan political interest but some issues worth considering are these, is the deputy gubernatorial candidate duly elected, if he is duly elected then there would be no need for a supplementary election, the next thing is that any candidate of a party must be sponsored by
the party which technically mean any party political aspirants must participate in a primary election or other modeof reaching a consensus candidate , do the deputy gubernatorial aspirant actually participated in the last party primary election, the answer is negative, so those forcing
his  elevation down our throat are just day dreaming, can the ruling party afford to go to another primary election, maybe Audu runner up should be giving the slot, you would agree changing a candidate should rather succeeded
cancelling the old election , some said the votes cast in favour Audu is first for the party but I insist that many may had been tempted to vote the party simply because of the party candidate which technically mean changing the party candidate can't but either encourage or discourage many from electing a party, what are we saying, if the ruling party is changing its candidate, let the party agree on a fresh election , this I don't want to say would be the position of law eventually if interpreted soon, I see a fresh
election even if the supplementary election hold next week Saturday as scheduled.

Your advice for our leaders most especially President Muhammadu Buhari

Who I'm I to advise Mr President? Well he should listen more to his critics than political sycophants.

Thanks for your time sir

You welcome!

Buhari Denies Reduction In Ministers Take Home

President Buhari
President Muhammadu Buhari denies any cut in the salaries of his ministers as against the news that he has approved pay cut for his executive members.

This he stated through his senior special adviser on media and publicity, Garba Shehu.
Garba Shehu, SSA media and publicity
In his tweets, Garba Shehu itemised the mind of the president as to the rumour flying around.

His tweets read:
1. President @MBuhari has not tampered with the salaries and allowances of Federal Ministers.

2. They remain as they have been prescribed by the Revenue Mobilization and Fiscal Commission under a law passed in 2008.

3. The President and the Vice President have voluntarily offered a 50 percent salary cut.

4. This is voluntary and does not apply to Ministers and other political appointees.

5. Reports to the effect that the President has imposed an austere package on the ministers are unknown to us.

6. The administration has not tampered with the salaries of ministers and that remain as prescribed under the law.

INEC Erred By Declaring Kogi Election Inconclusive #KogiDecides

In as much as I tried to remain mute to the conundrum in Kogi State presently due to the demise of Prince Abubakar Audu, the All Progressives Congress (APC) flag bearer in the last gubernatorial election in the state, the issue keeps re-echoing in my mind.

Though I'm not a lawyer but my sense is working. The shocking death of Audu no doubt was not premeditated nor envisaged but life must go on and there should not be a vacuum in governance.

The succession race was a tug of war but report reaching me says that the leadership of the All Progressives Congress (APC) has settled for a 40-year old Yahaya Bello who was came second in the primary (shadow) election that prpduced late Audu.

Though the position receives my blessing in that, he Yahaya Bello participated in the primary election then unlike Lagos-based Faleke that was 'handpicked' by late Audu Abubakar after securing the ticket after beating his contenders.

Inaruguably, the running mate to Audu, Faleke did not take or play a official role during the primary election.

I have read of some people claiming that the late Abubakar Audu's son, Mustapha Audu should be used to replace his dad. That idea was a bit utopia!

Is governorship now monarchical? For the fact that his wanted the seat is not a pointer that he wanted same as well.

Position of authority should be given to people that prepare for it. Going by the history of Nigerian presidents, only the incumbent, President Muhammadu Buhari is prepared to govern others were invited or imposed.

I elated that APC did not shot itself in the leg by presenting his son. I don't want to talk about his alleged rape case that is trending now in the news.

Since the dice has been cast, clash of Interest and supremacy battle can't be avoided because Faleke will be seeing the number one seat as his and the concormitant effect of this may be catastophic on the development of Kogi in the next four years.

Moreover, permit me to state that Independent National Electoral Commission (INEC) erred for declaring the election inconclusive... Hey! Listen to my reason first before you call for my head.

The flimsy reason made was because the Polling Units cancelled were more than the margin between the two leading candidates.

The voting strength of the Polling Units was announced as 49,953 while the difference between the two main contenders is 41,353.

Though I would have alligned myself with INEC but lo and behold report has it that only 35,000+ collected voters cards.

So for less than 40,000 to collect voters cards, this implies that if every one of the turned out to vote, their total votes will still be less than 40,000.

Now tell me, if they all vote for the incumbent governor, Idris Wada of the Peoples Democratic Party (PDP), can that invalidate the result?

Though I'm not a graduate of mathematics but I add two numbers together. So logically, the votes cancelled were less than the distance between the two leading candidates.

Conclusion
I call on the INEC to revisit the issue, so as not to create a constitutional problem for posterity. Because this issue can be avoided ab initio but never to late to admit their lacuna and correct it.

Meanwhile, the incumbent governor, Idris Wada and the running mate to Audu, Faleke have approached the courts.

#KogiDecides: The death and the inconclusive election

It happened between a father and his son. There was consistent wailing from the son and attempt to pacify him was becoming frustrated.

"Junior! Please stop crying, i said i will give you tomorrow!" This statement eluded more wailing, the son rolled on the floor with deafining noise tormenting the calmless of the father.

The father was confused and determined to halt his son idiosycracy, he cuddled him son, "I said i will give you tomorrow", With steady gaze , the boy retorted in comnanding tone"I want it now!".

With bewilderment, the father could not fathom the intricable tendency of his son in doubting the existence of tomorrow! The son had relied on his father habitual manner of playing with words.

The father often failed to keep it promise, making the word unrealiseable, the next day would surely bring to the forth the clamouring for tomorrow!

It seems the concept of tomorrow has eluded the mental faculty of those saddled with the responsibility of preparing and channelling an appreciable progress for the future.

It is a plague ravaging peculiar to Africa and inevitably Nigeria. The aftermath is continuos crises with endless riddles On November 21,2015 in Kogi state, electorates trooped out in multitude to elect their governor for the next four year.

The contest was between the incumbent governor, Idris Wada and the forner governor, Prince Audu Abubakar. While Wada contested under the platform of the Peoples' Democratic Party (PDP), Audu picked the tent of the All Progressive Congress (APC) After the election held under the watchful eyes of both the international and domestic observants, the battle was shifted to the collation center.

The revelation at the collation center evinced the intrigue and intricacy nature of the election with incessant cases of over voting and violence in some part led to the cancellation of the votes cast in 19 units.

When the total votes of the whole 21 local goverment areas were finally collation, it was discovered that the gap between the leading APC candidates, Prince Audu and Gov Wada was below the total sum of the total number of registered voters in the 19 units cancellation.

The INEC, the chief umpire, wielded its big stick by declaring the whole process inconclusive. Just as the whole country was asssimulating and analysing the scenerio, tragedy struck. The man leading in the election, Prince Audu died.

This has triggered off an avalanche of legal arguments brought about by constitutional lacuna. Had the results were declared before the demise of Prince Audu, Section 181(1)of the Nigeria constitution would have been invoked. By virtue of this, his running make, Hon Abiodun Faleke would have assumed a new status of Governor elect.

How ever, APC has been adviced by some legal practioners to take solace in section 33 of the electoral act.
The section provides, in effect, that if aperson has been duly nominated as a candidate of his party and he dies before the election then the political party has the right to replace him with another candidate and not necessarily the Deputy Governorship candidate. It makes a stark silence on the methods of presenting a new candidate.

The legal logjam of the scerio has brought to the fore the incapability of both the drafters of the Nigeria constitution and the electoral act their obvious impotency of making provision for the future! Othere wise their ingenuity should have been comprehensive and details not minding the macabre disposition it might appear to the citizenry.

The Kogi scenerio has brought more poisers:what would happen if after the election both the winning governorship candidate and his running mate or the winning presidential candidate and his running mate meet their untimely end?

Or if the unexpected happen to them on the way to be sworn in.
Our present phenomenon shows our inconsistent with the future and rare attempt at averting tomorrow.

EXCLUSIVE: Buhari’s Corruption Fight; Political Witch Hunt Says Tosin Arile

I like the word passionate, yes it's true I'm passionate about development of my people which I strongly believe criticism in form of activism is but the right tool to deploy making our government more responsible taking care of our plight, it's a fact that every government is lazy especially those in Africa where aura of being in power is the only thing motivating many  aspiring to political  offices, so the critics many called them are morally indebted rescue democracy  in form of restraining the excess of elected officers, you would agree being  passionate doing this is but a right thing .

So what is your assessment of the last general elections?

The election exposed the ethnic induced  Nigerian atleast judging the result which no doubt rigged in places where each party  actually has  an advantage or what some nick stronghold, Buhari won the north, Jonathan won in the south south and east, only the west voted massively a northerner and you would agree the position of the All Progressive Congress vice presidential slot conceded to the region assisted luring many the Yoruba  people, so as far as I'm concerned the last election is the poorest conducted in the history of the country, even in 2011, Jonathan got more votes in the north,  why now if not because the political hatred has succeeded eating the moral fabric of the nation, there's mistrust in the polity.

Don't you share the opinion that Goodluck Jonathan erred as to policy formulation and implemention in some areas which made people to clamour for change?? For instance, issue of corruption

As someone  who believe in justice, equity and fairness, I don't agree Jonathan failed, I've said it countless times that emergence of Jonathan is a political failure on the part of those who consider no shoe and goodluck sentiment in 2011,  a man can't give what he doesn't  have, it's justified that Jonathan failed in office because he only proved those who never voted for him in 2011 right that the outgoned president is intellectually incompetent to lead a nation like Nigeria, we must also thank Jonathan because his governic ineptitude popularly called cluelessness gave the change people a voice, for instance  if Jonathan had performed, we would never need a Buhari, yes it was apparent Jonathan has lost his headship because at a time he was quoted that if he fights corruption, that  corruption has potency fighting his second term ambition, which is more important to the people, his ambition or removing the cancer that has eating the political fabric of the nation, our only problem is corruption, so if many banked a believe that it's because Jonathan can't fight corruption they supported Buhari, the question we should ask now is if Buhari is actually fighting corruption.

Yes card readers doused the emotions of our people because without it and perhaps Jonathan had been declared a winner, strongly doubt if there would not be post election violence that is capable of threatening the sovereign integrity of the nation.

What can you say about the state of the nation now, I mean Muhammadu Buhari led federal government?

So far so good Buhari hasn't delivered anything other than political rhetoric, in fact the noise about fighting corruption has been loud and yet nothing worthwhile has been achieved, I wish he succeeded taming the cancer corruption but every day event proved otherwise, he seems to have soft spot for members of his political party who are corrupt atleast we saw how some ex governors with corruption allegations yet rewarded with ministerial appointment, in my view the president hasn't done anything substantial to know if he has delivered, the appointment so far is the only thing that could be credited to this incumbent administration and I make bold to say that it does not represent the collective yearning of a new Nigeria because it's a fact that it was ethnically skewed favouring a section of the country.

If   the president is serious about fighting corruption that would have significant effect on the psyche of our people then the fight charity must begin with the ruling party members, in fact Obasanjo should  first be prosecuted, anything short is mockery of the president allege  reputation  anything some may erroneously believed is his antecedent.

So what can you say on the present conundrum cum hullabaloo that is trailing death of Audu Abubakar and decision of INEC as regards last Kogi gubernatorial election by declaring it inconclusive?

Maybe I should say that the INEC declaration of the poll inconclusive is political, there is no antecedent worth using to emphatically predict the court but one thing I know, INEC has no legal jurisdiction to make further pronouncement on the said election, the court would say the next thing, many had said a lot, though many opinion is geared towards supporting their partisan political interest but some issues worth considering are these, is the deputy gubernatorial candidate duly elected, if he is duly elected then there would be no need for a supplementary election, the next thing is that any candidate of a party must be sponsored by the party  which technically mean any party political aspirants must participate in a primary election or other modeof reaching a consensus candidate , do the deputy gubernatorial aspirant actually participated in the last party primary election, the answer is negative, so those forcing his  elevation down our throat  are just day dreaming, can the ruling party afford to go to another primary election, maybe Audu runner up should be giving the slot, you would agree changing a candidate should rather succeeded cancelling the old election , some said the votes cast in  favour  Audu is first  for the party but I insist that many may had been tempted to vote the party simply because of the party candidate which technically mean changing the party candidate can't but either encourage or discourage many from electing a party, what are we saying, if the ruling party is changing its candidate, let the party agree on a fresh election , this I don't want to say would be the position of law eventually if interpreted soon , I see a fresh election even if the supplementary election hold next week Saturday  as scheduled.

Your advice for our leaders most especially President Muhammadu Buhari

Who I'm I to advise Mr President?  Well he should listen more to his critics than political sycophants.

Thanks for your time sir

You welcome!

#KogiDecides: APC Settles For Yahaya Bello As Abubakar Audu's Replacement

Yahaya Bello
After extensive consultations, the All Progressives Congress (APC) yesterday submitted the name of Yahaya Bello as the party’s new candidate for Kogi governorship supplementary poll.

Bello replaces Prince Abubakar Audu, who died last weekend after leading the poll with 41,000.
Yahaya Bello.

It was also learnt that the APC has retained Hon. James Abiodun Faleke as the party’s deputy governorship candidate.

Mohammed Audu, the son of the late governorship candidate, was dumped by the party because the party felt that fielding him might vitiate the entire governorship poll in
the state.

But the people of Kogi West were mounting pressure on Faleke yesterday not to accept the nomination of Bello.

Although they asked Faleke to withdraw from the race, the deputy governorship candidate was yet to make up his mind on the next step at press time.

Investigation by our correspondent revealed that APC leaders, with the backing of some forces in the Presidency, opted for Bello because he came second in the party’s primaries behind Audu.

It was also gathered that the APC leaders felt there was no way Mohammed Audu could be fielded as a compromise candidate since he was not a candidate in the primaries.

A top source in APC said: “Our leaders met and after consultations reached a conclusion on the choice of Yahaya Bello from Kogi Central as the party’s governorship candidate to substitute the late Prince Abubakar Audu.

“The leaders arrived at the conclusion because Bello was second to Audu at the validly conducted governorship primaries of the party.

Instead of running into crisis with fresh primaries, the party opted to dust up the result of the previous one which was witnessed by INEC.

“A letter, signed by the National Chairman of APC, Chief John Odigie-Oyegun, on the choice of Bello has been submitted to the Independent National Electoral Commission (INEC) on Friday.”

Asked of other factors behind the choice of Bello, the top APC leader said: “Our leaders bought into the idea that Faleke is strange to the politics of the state, having had most of his political career in Lagos.

They felt it is better for him to learn the ropes in the state before becoming a governor.

“They also argued that the choice of Bello will ensure power shift in the state and since the Ebiras were behind Audu, it won’t be difficult to foster understanding between Kogi East and Kogi Central Senatorial Districts.

“Do not forget that Kogi East had already produced the minister from the state.
“Another important factor is that some of the 91 polling units where elections were cancelled are in Kogi Central, and it will be easier to mobilize the electorate in the district to get the required votes to defeat the PDP candidate, Governor Idris Wada.

“There was also some conspiracy behind the refusal of the ticket for Faleke. Some presidency forces stamped their feet that he must not be allowed to step into Audu’s shoes because of internal power struggles in APC.

“I won’t give you names but the forced were more powerful than Oyegun and other NWC members.”

On the dumping of Mohammed Audu, the source said: “Our leaders were guided by Section 141 of the Electoral Act. If we choose him, the entire election will be voided.

“The section says: ‘An election tribunal or court shall not under any circumstance declare any person a winner at an election in which such a person has not fully participated in all the stages of such election.

“We love the Audus but we cannot take such a big risk. If Wada and PDP go to court, they will win against Mohammed Audu.”

As press time, there was pressure on Faleke by the people of Kogi West to opt out of the race.
A different source said: “There are many options open to Faleke but the people of Kogi West want him to withdraw from the race.

If Yahaya Bello gets the ticket, he might be reduced to a dummy deputy governor.
“Unless Faleke can fight his cause in court and claim his mandate, he will be frustrated as a deputy governor.

If he quits, the party will have justification for bringing Mohammed Audu and Kogi West will be politically alienated.”

NCC to fine MTN, Airtel, Globacom over auto migration of data service

The Nigerian Communications Commission (NCC) on Monday said it would sanction MTN, Airtel and Globacom for defying the directive on automatic migration to Pay-As-You-Go data bundle.

The commission made this known in its `2015 3Q Compliance Monitoring and Enforcement Report’, obtained by the News Agency of Nigeria (NAN) in Lagos.

NCC said it had continued to receive complaints from subscribers on automatic migration of data bundle package to Pay-As-You-Go Billing on depletion of their data bundle.

”Consequently and pursuant to section 53(1) of the NCA 2003, the commission on 3rd August 2015 directed all mobile service operators to comply with the data bundle directions.

”That where a subscriber’s data bundle account is fully depleted before the due date, service providers should notice the subscriber via SMS, giving information regarding the tariff/ billing rate for automatic migration.

”That all service providers should henceforth stop auto-migration of subscriber’s data service to the Pay-As-You-Go (PAYG) account upon depletion of the data bundle account, except with the express consent and authorisation of the subscriber via SMS,” it said.

The regulatory body said that a follow-up compliance check was carried out which revealed that Etisalat was in compliance with the directives.

It said that Etisalat through SMS notified its subscribers of depletion of their data bundle accounts, before due dates.

The telecoms regulator also said that Etisalat sought the consent of subscribers before automatically migrating them to the Pay-As-You-Go data service.

”Globacom is in compliance with Direction No. 1 as subscribers receive SMS detailing tariff rate for auto-migration on depletion of their data bundle.

”However, Globacom failed to obtain express consent from subscribers before migration to PAYG and therefore in violation of Direction No. 2.

”MTN is in compliance with Direction No.1 but failed to highlight the tariff rate for PAYG billing. In addition, data service is not suspended on depletion of the data bundle account even without an authorisation via an SMS from the
subscriber.

”Airtel is not in compliance with the above directions.
”Consequent upon the above, the commission has issued a notice of intention to sanction the concerned service providers,” NCC said.
