Olubadan Stool: Court rejects Seriki’s move to stop Olubadan’s installation

Justice Muktar Abimbola of the Oyo State High Court, Ibadan, on Tuesday, refused to grant an application filed by head of Seriki line, Chief Adebayo Oyediji, seeking the order of the court to stop the governor of Oyo State, Senator Abiola Ajimobi, Olubadan-in-Council from appointing/installing new Olubadan.

Oyediji through his counsel, Mr Abideen Adediran, through an application filed on February 8 had sought the order of the court to stop the Olubadan-in–Council from appointing the new Olubadan after the demise of the 40th Olubadan, Oba Samuel Odulana Odugade I, onJanuary 19.

Adediran told the court that they were aware that the respondents; Governor of Oyo State, Attorney General of the state and the Olubadan-in-council, have completed plans to appoint the new Olubadan of Ibadan land.

Justice Abimbola said that the respondents should be put on notice so that they could file their response.He told the claimants not to worry, saying the court has the power to still remove the Olubadan if he was appointed illegally as being claimed by the claimant.

Justice Abimbola, however, granted a motion on noticeseeking to serve the defendants by pasting a writ of summon on the wall of the chamber of the Olubadan-in-Council located at Mapo in Ibadan South west local government.

The head of Seriki Chieftancy line, Chief Oyediji is claiming that it is the turn of their line to produce the next Olubadan, following the death of Oba Samuel Odunlana.

The plaintiff is challenging the alleged consistent occupation of the throne by the Olubadan chieftaincy line and the Balogun Chieftaincy line.

Their lawyer drew the attention of the court to its subsisting order of interim injunction restraining the respondents from filling any of vacant high chief positions and that of the Olubadan.

He alleged that the Olubadan and the Balogun lines had disobeyed the order of the court by filling all the vacant high chief positions- “Ekerin, Asipa, Otun and Osi,” accordingly.

Adediran prayed the court to set aside all the purported appointments.Justice Abimbola then adjourned the case till March for argument.
